However, we continue to overlook an equally critical aspect: mental and social health in the workplace.  <\/strong><\/p>\n\n<p>Mental health remains an \u201cinvisible\u201d issue. It is not easily recorded, it is not reflected in statistics with the same clarity, and it is not always recognized as an occupational hazard. And perhaps that is why it remains one of the most overlooked and undervalued areas when it comes to labor rights.  <\/p>\n\n<p>And yet, the current legal framework leaves no room for misinterpretation. At the European Union level, the right to safe and healthy working conditions is enshrined in the Charter of Fundamental Rights of the European Union, while Directive 89\/391\/EEC imposes on employers the obligation to prevent all occupational risks, including psychosocial ones. <\/p>\n\n<p>At the same time, at the international level, the International Labour Organization is increasingly recognizing the importance of mental health as an integral part of decent work.<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-text-align-center\">See also: <a href=\"https:\/\/diversitynews.eu\/en\/13\/03\/2026\/landmark-ruling-by-the-ecj-it-requires-legal-recognition-of-gender-identity-in-all-member-states\/\" target=\"_blank\" rel=\"noreferrer noopener\">Landmark ruling by the ECJ. It requires legal recognition of gender identity in all Member States <\/a><\/p>\n<\/blockquote>\n\n<p>In practice, however, mental health continues to be treated as a \u201cpersonal matter\u201d rather than a responsibility of the workplace. Exhausting hours, precarious conditions, job insecurity, toxic cultures, and discrimination are some of the factors that directly affect the health and dignity of working people. <\/p>\n\n<p>The lack of meaningful recognition of psychosocial risks constitutes a gap in protection, and this gap affects not only the workplace but also quality of life, the rule of law, and, of course, democracy itself.<\/p>\n\n<p>The right to health, including mental health, and the right to a safe working environment are fundamental human rights.
