Gender and Identity in Focus: New Guidelines in Scotland

Police Scotland recently announced changes to its gender recording policy, redefining how relevant data is collected and recorded in all cases.

Under the new guidelines, biological sex will be recorded, while there will also be a separate indication of whether a person is transgender. This approach will apply to all individuals involved—from victims and complainants to suspects, defendants, and persons at risk.

The previous practice, established during Nicola Sturgeon’s administration, allowed for self-declared gender recording. It is worth noting that these were guidelines and not binding legislation.

This change comes within a broader context of public discourse and developments in the United Kingdom regarding gender and rights issues. These include legal challenges, such as the one brought by For Women Scotland, as well as recent court rulings that affect how gender is defined in the legal framework.

In a statement, the police emphasized that the technical adaptation of systems is a complex process, as a clear distinction between biological sex and gender identity is required to avoid any confusion or alternative use of the terms.

Interim guidance on the new policy is expected to be published in April 2026, with the aim of gradually transitioning to a clearer and more functional recording system.
